I think it's a copy right. Remember that Dota is not a MOBA, actually is an Action RTS or ARTS. Thus the term Action was given by Gabe don't know why, but under WCIII it was RTS only. The term MOBA was invented by Riot Games - Guinsoo to separate LoL from Dota.

well i just read that they are closing the game so guess Riot and Valve got to them ;)
